GENERAL TERMS AND CONDITIONS FOR USE AND SALE OF GOODS VIA AN E-COMMERCE WEBSITE

These General Terms and Conditions are effective between: Ecosem Bulgaria Ltd., UIC: BG203612504, with its registered office and management address at 31 Parva Str., Stambolovo 5249, Bulgaria, hereinafter referred to as the SUPPLIER, on one hand, and the person who has agreed to these "General Terms and Conditions," hereinafter referred to as the USER, in connection with ordering and purchasing goods offered through the online store www.ecosem.bg.

Please read these General Terms and Conditions carefully. They govern the relationship between the Supplier and the Users (customers) who use the online store www.ecosem.bg to purchase goods. By clicking on any object, image, link (other than the link to the General Terms), or button located on the website www.ecosem.bg, it is considered that you accept or agree to the General Terms and Conditions described below. These General Terms and Conditions comply with the requirements of the Consumer Protection Act (CPA) and other regulations effective in the Republic of Bulgaria. If you do not agree with these General Terms and Conditions, please do not continue using www.ecosem.bg.

I. CONCEPTS AND DEFINITIONS

1.1 For the purposes of these General Terms, the following terms shall have the following meanings:

  • "Supplier": Ecosem Bulgaria Ltd., owner of the website www.ecosem.bg, which serves as a virtual platform for the sale of goods.

  • "User": A legally capable person who has agreed to these General Terms and Conditions.

  • "Online Store": The website www.ecosem.bg, serving as a virtual platform for offering goods for distance sale.

  • "User Profile": A section of the site containing information about the User, provided during registration.

  • "Order": A request made by a User to purchase one or more specific items.

  • "Sale Price": The final price per unit or quantity, including VAT and all applicable taxes and fees.

  • "Courier": A merchant who physically delivers the purchased goods to an address specified by the User.

  • "Newsletter/Brochure": Electronic information messages regarding goods sold in the online store over a specific period.

II. TERMS OF USE OF THE ONLINE STORE

2.1. Browsing the online store www.ecosem.bg is free and accessible worldwide. 2.2. Users may use the information published on the site for personal, non-commercial use only. Copying, distributing, or manipulating the content is prohibited. 2.3. Registration with an email and password is required to shop. Registration is free. 2.4. Data Protection: Personal data provided (names, address, phone, email) are protected under the Personal Data Protection Act and are collected solely for the purpose of delivery via courier. 2.5. The Supplier does not sell, rent, or trade personal information to third parties. 2.6. Product Information: The Supplier publishes descriptions, images, prices (including VAT), and delivery costs for each item. 2.7. Price Changes: The Supplier reserves the right to change prices, quantities, and site design. For orders already placed, if a significant change occurs (price or delivery time), a representative will contact the User for confirmation. 2.8. User Obligations: The User must provide a valid phone/address, pay the price of the goods and delivery, and protect their password. 2.9. The User must not violate third-party intellectual property rights or interfere with the website's technical operation.

III. REGISTRATION AND BROCHURES

3.1. The User must provide true and accurate data during registration and update it within 7 days of any change. 3.2. By registering, the User gives "online" consent to these General Terms. 3.3. Marketing: By accepting these terms, the User agrees to receive newsletters and promotional messages via email or SMS. Users may unsubscribe at any time via the "Unsubscribe" link or by contacting the Supplier directly.

IV. PLACING ORDERS

4.1. Orders are placed by selecting items, adding them to the cart ("Buy"), and confirming the delivery address and payment method. 4.2. After an order is placed, an automated notification is sent to the User's email. 4.3. If a specific item is out of stock, the Supplier will notify the User to offer a substitute or cancel the order. 4.4. Orders are accepted 24/7. Standard processing and delivery occur within 3 working days after confirmation.

V. DELIVERY AND PAYMENT

5.1. Delivery is only made for confirmed orders within 3 working days, unless otherwise specified. 5.2. Carriers: The Supplier uses Speedy, Econt, and Sameday. 5.3. Address: Delivery is made to a specific address or a courier office/locker as chosen by the User. 5.4. Failure to Receive: If the User does not provide access for delivery or fails to collect the item from an office in time, the Supplier is released from the obligation to deliver. New shipping costs will apply for re-delivery. 5.5. Payment Methods:

  • Cash on Delivery (Postal Money Order): Payment in cash to the courier upon delivery. 5.6. Currency: All prices are in EURO (EUR) and include VAT. Delivery costs are calculated at checkout.

VI. WITHDRAWAL, RETURNS, AND CLAIMS

6.1. Right of Withdrawal: The User has the right to return goods within 14 days of receipt. 6.2. Claims: In case of a claim, the User may choose a replacement (size/color/defect-free item) or a full refund. 6.3. Shipping Costs: For exchanges or returns at the customer's request (not due to merchant error), shipping costs in both directions are at the expense of the User. 6.4. Condition: Returned items must be in their original packaging, with a good commercial appearance, and no mechanical damage.

VII. INTELLECTUAL PROPERTY

7.1. All information, including photos and descriptions, is the property of the Supplier. 7.2. Copying texts is prohibited without written consent or clear citation: "Source: Online store for bio foods and products www.ecosem.bg".

VIII. LIABILITY

8.1. The Supplier is not liable for technical errors, omissions, or problems caused by force majeure or internet connectivity issues. 8.2. The Supplier is not responsible for damages to software or hardware resulting from the use of the site. 8.3. The Supplier is not liable for the content of external websites linked within the store.

IX. FEEDBACK

9.1. Users can contact the Supplier via email (info@ecosem.bg), phone (+359 889 570 058), or the contact form. 9.2. The Supplier reserves the right to remove obscene or offensive comments from the website.

X. GENERAL PROVISIONS

10.1. Users may request account deletion at any time after fulfilling all pending orders. 10.2. If any clause is found invalid, it will be replaced by the mandatory rules of the law, and the rest of the terms remain in effect. 10.3. Disputes: All disputes shall be resolved through negotiations or, if unsuccessful, by the competent court in Sofia, Bulgaria. 10.4. Governing Law: For all issues not settled herein, the legislation of the Republic of Bulgaria shall apply.
